General terms and conditions


1. Scope

These General Terms and Conditions apply to all contracts for the rental of hotel rooms for accommodation that are concluded between Hotel Crystal and third parties (guests) and to all other services and deliveries provided by Hotel Crystal (guest accommodation contract).

 

2. Reservations

By making a reservation, the guest offers to conclude a guest accommodation contract. If the booked room is available, the guest will receive a reservation confirmation from Hotel Crystal. By accepting the reservation made by the guest, a guest accommodation contract is concluded between Hotel Crystal and the guest.

Offers from Hotel Crystal in relation to available rooms are subject to change and non-binding. Hotel Crystal can, at its own discretion, refuse to conclude a guest accommodation contract.

There is no entitlement to use the overnight service in a specific room. Hotel Crystal reserves the right to define industry-standard restrictions such as minimum stays, booking guarantees or deposits for specific dates.

 

3. Cancellations

A reservation is guaranteed when the guest confirms payment for the accommodation service by providing a credit card number. A guaranteed reservation can be canceled free of charge up to 6 p.m. on the day of arrival, stating the reservation number. Cancellation after 6 p.m. is not possible and Hotel Crystal retains the right to the agreed remuneration less any expenses saved. The same applies if the guest fails to appear (no-show). In the case of multi-day guaranteed reservations, all subsequent nights from and including the second night will be canceled in the event of no-show and the guest is not entitled to the subsequent nights.

Simple reservations, ie reservations for which payment by the guest is not yet guaranteed, are valid until 6 p.m. on the day of arrival. After 6 p.m. the reservation expires automatically and free of charge. Hotel Crystal is entitled to rent the reserved room to someone else. Cancellations are only accepted in writing by email to: info@hotel-crystal.de.

 

4. Accommodation prices and other prices

The prices shown by Hotel Crystal at the time the contract was concluded apply. The applicable prices are total gross prices and include all statutory taxes, fees and charges. Not included are local taxes that are owed by the guest themselves according to the respective municipal law, such as visitor's tax.

Hotel Crystal reserves the right to adjust the prices accordingly in the event of a change in the rates of taxes, fees and charges as well as the effective levying of new taxes, fees and charges previously unknown to the parties. In the case of contracts with consumers, this only applies if the period between the conclusion of the contract (booking confirmation) and the adjustment of the contract exceeds four months.

 

5. Terms of Payment

The price of the entire booked accommodation service must always be paid by the guest, at the latest on departure from the hotel. Declarations of assumption of costs are only accepted in writing and with valid credit card data. A set-off by the guest is excluded, unless the set-off relates to an undisputed or legally established claim. Valid means of payment are cash in euros, EC card, Master Card, Visa Card and American Express. To process payments, we use the 3D-Secure 2.0 process for secure and enhanced customer authentication. 6. Possibilities of using reserved rooms

Reserved rooms are available to the guest from 3 p.m. on the day of arrival and until 11 a.m. on the day of departure. Upon request and subject to availability, a later departure (late check-out) can be arranged with the hotel in advance. If the hotel agrees to a late check-out, the hotel is entitled to charge EUR 15.00 per hour or part thereof for the additional use of the room. For departures after 3 p.m., the full daily rate of the room will be charged. There is no contractual right to a late check-out.

 

7. Resale

The resale/renting and/or the brokering of booked rooms is prohibited. In particular, the forwarding of rooms and/or room contingents to third parties at higher prices than the actual room prices is not permitted. The assignment or sale of the claim against Hotel Crystal is also not permitted. In these cases, Hotel Crystal is entitled to cancel the booking, especially if the guest has given false information to the third party about the type of booking or the payment during the assignment/sale. Use of the hotel room for any purpose other than accommodation is expressly prohibited.

 

8. Liability

Hotel Crystal is liable for damage to life, limb or health for which it is responsible. Furthermore, Hotel Crystal is liable for other damages based on an intentional or grossly negligent breach of duty by Hotel Crystal as well as for damages based on an intentional or negligent breach of typical contractual obligations. A breach of duty by Hotel Crystal is equivalent to that of its legal representatives, employees or vicarious agents. Further claims for damages are excluded, unless otherwise regulated in these General Terms and Conditions.

Should disruptions or defects in the services of Hotel Crystal occur, Hotel Crystal will endeavor to remedy the situation if it becomes aware of it or if the guest complains immediately. The guest is obliged to do what is reasonable for him to remedy the disruption and to minimize possible damage. In addition, the guest is obliged to notify Hotel Crystal in good time of the possibility of exceptionally high damage occurring.

Hotel Crystal is liable for items brought in according to the statutory provisions. The claim expires if the guest does not report the loss, destruction or damage to the item brought to Hotel Crystal immediately after becoming aware of it. If the guest wishes to bring money, securities and valuables with a value of more than EUR 800 or other items with a value of more than EUR 3,500 into the hotel, this requires a separate written agreement with Hotel Crystal.

If the guest is provided with a parking space in the hotel garage/parking lot, even for a fee, this does not result in a safekeeping contract. There is no monitoring obligation on the part of Hotel Crystal. Hotel Crystal is liable for all damages within the scope of the regulations mentioned in this clause 8. The guest is obliged to report any damage immediately, obvious damage, at least before leaving the parking facility. Hotel Crystal is not liable for damage for which other tenants or other third parties are solely responsible.

All claims against Hotel Crystal expire within one year from the start of the statutory limitation period. This does not apply to claims for damages or other claims resulting from injury to life, limb or health and/or due to a grossly negligent or intentional breach of duty by Hotel Crystal.

 

9. Termination of the guest accommodation contract

Hotel Crystal is entitled to terminate the guest accommodation contract for good cause. An important reason exists in particular if (i) force majeure or other circumstances for which Hotel Crystal is not responsible make it impossible to fulfill the contract, (ii) rooms or rooms are booked culpably with misleading or false information or with the concealment of essential facts; the identity of the guest, the ability to pay or the purpose of the stay can be essential, (iii) Hotel Crystal has reasonable grounds to assume that the use of the service can endanger the smooth business operations, the security or the reputation of Hotel Crystal in public, without that this is attributable to the sphere of control or organization of Hotel Crystal; (iv) the purpose or occasion of the stay is unlawful; or (v) in the event of resale/rental and/or onward brokerage (see Clause 7).

 

10. Vouchers

A voucher purchased from Hotel Crystal can only be redeemed for hotel services. If there are remaining credit balances when making payments with the voucher, they remain in place and can be used for further payments. The voucher is valid for 3 years from the date of issue. Vouchers are non-returnable, non-resalable, non-transferable and non-redeemable for cash. The vouchers cannot be used for online payments. The person ordering the voucher is responsible for providing the correct data (in particular the e-mail address) to which the voucher and the invoice should be sent.

Cancellation policy: Declarations on vouchers can be revoked within 14 days without giving reasons in any form (letter, fax, e-mail) or, if the voucher is provided before the deadline, also by returning the voucher. The period begins after receipt of this instruction in text form, but not before receipt of the voucher by the recipient. To meet the cancellation deadline, it is sufficient to send the cancellation or the voucher in good time. 11. Food and drinks brought in

In the public areas, the consumption of food and drinks you have brought with you is prohibited. Breakfast can only be taken in the designated areas of the public area (breakfast room, bar, inner courtyard). Breakfast items can be taken away for an additional charge. The preparation of food in the rooms is prohibited.

 

12. No smoking in the hotel

The Hotel Crystal is a non-smoking hotel. It is therefore forbidden to smoke both in the public areas and in the guest rooms. In the event of an infringement, Hotel Crystal has the right to demand an amount of EUR 200.00 from the guest as compensation for the cleaning costs to be paid separately, including any loss of revenue from the room being unable to be rented as a result. This amount of damages is to be set higher or lower if Hotel Crystal can prove greater damage or the guest can prove less damage. Designated smoking areas, terraces and balconies are excluded from this rule.

 

13. Pets

Bringing a pet requires the consent of Hotel Crystal. The guest is obliged to announce the wish to bring a pet in advance. If Hotel Crystal agrees to bringing the pet along, this is on the condition that the pet is under the guest's constant supervision, is free of diseases and otherwise does not pose a danger to the hotel guests and hotel staff. Pets are not permitted at breakfast or at the hotel bar. There is a fee of EUR 12.00 per night for the pet. However, guide dogs, deaf dogs and other comparable service dogs are exceptions. These may be carried free of charge and at any time.

 

14. Special payment and cancellation conditions

Separate payment and cancellation conditions apply to group bookings of more than ten people/rooms, contingent contracts or correspondingly defined periods of time. These are shown in the booking process and on the booking confirmation or result from the relevant contracts. Cancellations are only accepted in writing by email to: info@hotel-crystal.de.

16. Final Provisions

Changes and additions to the guest accommodation contract or the general terms and conditions must be in text form. Unilateral changes or additions by the guest are invalid.

The place of jurisdiction for all disputes arising between the parties from the contractual relationship is Saarbrücken, insofar as the guest is a merchant, a legal entity under public law or a special fund under public law. In all other cases, Saarbrücken is the place of jurisdiction if the requirements of Section 38 (2) ZPO are met and the guest does not have a general place of jurisdiction in Germany.

German law applies. The application of the UN sales law is excluded.
